Largest rolling or largest angleshoot?
A report abuse thread was made today by GridIronJesse in regards to the 3rd place finish that fockla had in the Sunday Million last Sunday. The stake that fockla was running for jesse included $26 and under mtts along with $10 and under rebuys, but when fockla ran the million on Sunday he included the tournament in the rail along with how many entrants were in the tourney. Jesse feels that he is entitled to his share of what fockla won, but fockla stated in his appeal that the tournament was only in the rail in case he won enough to add a bonus to the stake. There is no prescedent for a situation like this, and the massive amount of money has made it a very tough situation. The tournament wasn’t supposed to be played for the stake, and if he would have lost and included it in the stake, he would have been forced to add back the buy in to the bankroll. However, since he cashed in the tournament the question is does he owe the money he won to the stake? Obviously if we knew focklas real intentions this would be an easier case, but it also could be a big angleshoot in that he would subtract the buy in from the bankroll if he lost but only add bonus money if he won. Furthermore the conversation between the two in PMs never clearly stated nor asked the question of whether fockla was playing the tournament for Jesse’s stake or not. Joeker has stated in fockla’s appeal that he will make a ruling tomorrow, but it would be preferrable if the two could work soemthing out between themselves.

The ambiguity of your post is where the problem comes in. You shouldn’t have to go back and edit the rail afterwords with your true intentions. They should be spilled out completely before you play. If you had never put it in the rail in the first place, there would obviously be no problem either. The second you put it in the rail though, as a backer, I would expect that you are playing it for me even if it falls out of the BR rules (which I would deal with separately after I noticed it).
In my opinion, you both have good points but from being a member of the site for a while now and both playing staked and doing a decent amount of staking, I would have to say that as soon as you put it in the rail w/o any other stipulations, it’s being played for Jesse.
You really don’t want to keep DNS. You will easily get back for the WSOP, Sunday Majors, FTOPS, WCOOP, …. for making this situation right. And you can probably make it right for a lot less than $50K. I would guess that if you were willing to pay out $x of the winnings it would rectufy the situation, we could chalk it up to a beginers mistake, and you could get the DNS off and get big backing in the future which would be worth a lot more in the long run than the money you are paying out right now is.”
